WHEREAS, St. Landry Parish is entitled to make land use and historic preservation
ordinances to ensure that no particular individual may make use of his private property to
the severe detriment of others, and to preserve the historic heritage and character of the
Parish.
WHEREAS, St. Landry Parish Home Rule Charter Sections 1,-02 and l-06 establish that
the Parish has the special power to pass all ordinances necessary to promote, protect, and
preserve the general welfare, safety, health, peace, and orderly conduct of the Parish.

BE IT FURTHER ORDAINED BY THE COUNCIL FOR ST. LANDRY PARISH
GOVERNMENT THAT in regard to the foregoing roads and streets that mobile homes,
manufactured homes, and modular homes are prohibited from being located on, mobile
homes, manufactured homes, and modular homes shall be defined as follows:
Manufactured home/mobile home means a moveable detached single family dwelling unit with all the following characteristics:
(1) Designed for long-term occupancy, and containing sleeping accommodations, a flush
toilet, a tub or shower bath and kitchen facilities, with plumbing and electrical connections
provided for attachment to outside systems;
(2) Designed and constructed on a chassis that is capable of being transported after
fabrication on its own wheels or detachable wheels bearing a label certifying it is built in
compliance with the Federal Manufactured Home Construction and Safety Standards Act of 1974 (42 U.S.C.-501), which became effective June 15, 1976;
(3) Arrive at a site where it is to be occupied as a dwelling complete and ready for
occupancy, except for minor incidental unpacking and assembly operations, instatled by a
licensed installer, connections to utilitiesl and

(4) Not required to be placed on a foundation. (Does not refer to travel trailers, truck
campers, camping trailers, or similar units designed for recreation or other short-term
use).
Modular home means any home factory-built to local state code. In some cases, a state may
have adopted one of the uniform construction codes (i.e., UBC, IRC, etc.). Modular homes
will not have the red certification label but will have a label attached to the home identifying
the code with which it complies. The appropriate state modular code agency will be able to
assist in locating the modular label. A modular home can be as an tton-framett or “off-framet’
modular. On-frame will be built on a permanent chassiso whereas the off-frame modular will
be built with the removal of the chassis frames in mind. An off-frame modular will usually
require additional cranes to assist with home placement. Modular homes are, more often
than not, attached to private land.
BE IT FURTHER ORDAINED BY THE COUNCIL FOR ST. LANDRY PARISH
GOVERNMENT THAT the section prohibiting mobile homes, manufactured homes, and
modular homes from being located on the foregoing listed roads and streets shall not apply
to mobile homes, manufactured homes, and modular homes that are located on the foregoing
listed roads and streets prior to the enactment of that section.
BE IT FURTHER ORDAINED BY THE COUNCIL FOR ST. LANDRY PARISH
GOVERNMENT THAT this ordinance shall become effective on the date that it is enacted.

An Ordinance to set regular meeting dates for the St. Landry Parish Council Meetings for the year
2026 on the third Wednesday of each month at six o’clock p.m. and for the Public Works and
Administrative/Finance Committees to meet on the first Wednesday of each month at
six o’clock p.m. with the exception of March 4,2025 in reserve of PJAL Conference.

ORDINANCE NO. 2025-045

AN ORDINANCE TO ENACT POLICIES AND PROCEDURES FOR PRIVATE ROADS
THAT ARE INSIDE SUBDIVISIONS TO BE ACCEPTED INTO THE PARISH ROAD
SYSTEM AND BECOME A PUBLIC ROAD IF THOSE PRIVATE ROADS MEET
CERTAIN REQUIREMENTS
WHEREAS, Article Io Section 1-06 of the St. Landry Parish Home Rule Charter states that the
parish govemment shall have the power to pass all ordinances necessary to promote, protect, and
preserve the general welfare, safety, health, peace, and orderly conduct of the parish, and this
includes the power to pass ordinances on all subject matters not inconsistent with the constitution
or denied by state law.
WHEREAS, the general public frequently drive automobiles on private roads, as well as
public roads, for transportation throughout St. Landry Parish.
WHEREAS, the condition of disrepair on private roads can pose a danger to the health and
safety of the general public, as well as cause damage to their automobiles resulting in costly
repairs.
WHEREAS, this Ordinance will provide for private roads in subdivisions to be taken into
the parish road system and made a public road if those private roads meet certain requirements.
BE IT ORDAINED BY THE COUNCIL FOR ST. LAT\DRY PARISH GOVERNMENT
THAT policies and procedures for acceptance of private roads that are inside subdivisions into
the parish road system wherein they will become public roads shall be enacted into the St.
Landry Parish Code of Ordinances:
Policies and procedures for acceptance of private roads that are inside subdivisions into the
parish road system and designate them a public road.
A private road which is located in a subdivision in St. Landry Parish may be taken into the
parish road system and made a public road if:
(a) There are ten or more houses on the private road.
(b) All of the owners of the houses and/or land on the private road consent to the
conveyance of the private road to the parish and sign a request that the road become
a public road.
If these requirements are met, the Parish President will review the factors concerning the
request that the private road be made a public road, and then determine if the private road
will be taken into the parish road system and be made a public road.
If the Parish President determines that the private road shall be accepted into the parish
road system and become a public road, the matter shall be placed before the Parish Council
so that they may enact the appropriate ordinance to accept the road and make it a parish
road.

ADMINISTRATIVE/FINANCE COMMITTEE MEETING MINUTES

  1. Administrative Finance Chairman Harold Taylor called this meeting of the
    Administrative/Finance Committee of the St. Landry Parish Council to order.
  2. Councilman Ernest Blanchard led the Pledge of Allegiance & Invocation.
  3. Roll Call: Faltery Jolivette, Harold Taylor, Ken Marks, Timmy Lejeune and
    Ernest Blanchard. Ex-Officio Jody White. ABSENT: Dexter Brown.
  4. Person to address the Committee.
    Mr. James Demoruelle addressed the council He statedr “Good afternoon gentlemen. I
    am James Demoruelle and I am from Ville Platte. I represent anorganization here tonight
    to be formed recently in St. Landry Parish, in fact we leased your Yambilee Building week
    before last to be able to do that. We are representing Cock Fighters from around the state of
    Louisiana. Since the law was passed when they were legal we did a lot of leaming. We
    found many places in our Constitution where the law is violating our Constitutional Rights,
    our Bill of Rights. I know the constitution is especially important to you gentleman, you all
    took an oath to defend the constitution against enemies foreign and domestic. I am here
    tonight with you to give you all an opportunity just to do that to defend the constitution.
    Now you ask yourself where, where do we need defense. Well to start the very first thing in
    our constitution is that we have individual rights. We have a right to self-determination and

any part of this that is violated is unconstitutional. As a Cock Fighter I have no right to self-
determination because I determine myself to be Cock Fighter. However you feel about it

and I give you your right to feel about it any way you want, trust me. It really doesn’t make
any difference because the constitution is about the individual and not the goup. It defends
the individual from the group so your feelings are yours and mind are different. People say
Cock Fighting is cruel and it should not be done but there is no definition of cruelty.
Cruelty is something you see in your head and that is what is cruel for you, for me it is
different, it us just different. I want my rights back, I want to be able to meet with my
friends. I brought some today, would you all stand up. The people here represents banking
in major businesses and some are in government. You have one member who is not here
this evening who is the chief of police. We have a judge, a Federal Marshal that
occasionally attend our fights and we still fight. When they passed the law they did
something else, they did something very egregious. They took away police protection for a
large group of people when they knew we would not stop Cock Fighting. There is no place
in the world, no place where Cock Fighting Laws have been passed and people stop Cock
Fighting. It just became a problem for the courts. In our country we have a right to address
our government and ask for corrections and that is what I am doing here tonight. I want to
apply to the Parish of St. Landry to be issued a license for a Cock Fighting Facility. It is
illegal to operate a restaurant without a license or sell used cars without a license because
that is illegal. Cock Fight is illegal but I want a license. You can look at each other and say
that this guy is crazy we can’t give him a license but I am asking because you all are
responsible to support and protect my Constitutional Rights to ask the State Attomey
General for a determination on the Constitutionality of Cock Fighting. I had ask to meet
with your attomey to discuss our points so that he could do a letter or be prepared to do one
on our point of view, the way that we see the violations. Like the Fifth Amendment, the
Fifth Amendment is not just about not having to convict yourself in court it is also about
property rights and property is a chicken. I have a right to own a chicken because there is
no law in this state or in this country that says you can’t own a chicken. They have some
that says you can’t fight them but they are my property. How can you possibly convict a
person to commit a crime against his own personal property, it does not make any sense. If
it is your personal property you have a right to use your property as long as I don’t us my
property in such a way that it would put your life in danger or damage your property. If I
were with a group of people that agrees with me and we were in a private place and we are
each using our chickens, we are not taking anyone’s chickens and we are not using money
that goes to the govemment we use our own money and our own chickens in private and the
right of privacy is protected except if you are a Cock Fighter then it is not protected. I am
not going to ask you all to legalize Cock Fighting, not today but I am going to ask that you
authoize your attorney to meet with me and ask the State Attomey General to give a

determination based on that letter or any meeting that you may want to hold later. That is
the vote that I am looking for tonight.”
Councilman Timmy Lejeune questioned, “I don’t oppose and I am not telling you that I
support but I do want to ask is this: How much money is involved in this? What I mean by
that, it is not my nickel but nobody in this auditorium or this chamber bets on Cock
Fighting?”
Mr. James Demoruelle statedr “Sure we do.”
Councilman Timmy Lejeune questioned, “What would be our share as a parish, 20oA,30o
that we would get from the gambling that goes on atthat Cock Fight if there is a facility in
St. Landry Parish.”
Mr. James Demoruelle stated, ‘l can’t speak for our business people but I will give you an
answer. I can’t give you a definite answer but I will tell you right here and now if they were
to lift their hand and say do they care how much we give you we want the right to frght and
if you make all of the money, personally I don’t care and some other people won’t care. It
is not about how much money that we keep it is about our rights. You can have a private
membership and you can have all the money from the mernbership, $500.00 a year per
person. If you want to do a seat tax and part of the admission goes to paylng for a seat you
can tax that seat. There are a lot of different ways that we can work it out to make it good
for the parish and good for the school board and other people that you want to spend the
money with.
Councilman Timmy Lejeune stated,”Irealize that this industry is very big and I will wrap
it up but I do realize that that industry at one time was a huge industry at one time.”
Mr. James Demoruelle stated, “It is, we had people coming here from England, Ireland,
Indonesia and the Philippines, they were coming right here to Sunset.”
Councilman Timmy Lejeune stated, “Some of these roosters are in the thousands of dollars
a bird, I get that too but what happens to the humane side of that? I know that you have the
right to kill your chicken if that is what you want to do whether you want to make a gumbo
or you want to watch them beat each other up, I get that.”
Mr. James Demoruelle stated, “Don’t get me started with the Gumbo side of.”
Councilman Ken Marks questioned, “My question is this: Are there any other parishes in
the state of Louisiana that offers permits for this cock Fighting aspect?”
Mr. James Demoruelle stated,’You have the honor of being the first one asked. We have
not ask anyone else.”
Councilman Ken Marks stated, “Okay, so the State Constitution has it written in the area as
unlawful is that correct?”
Mr. James Demoruelle statedr’nThe State Legislature passed a law. What we have come
to learn is that the Legislature has no right to criminalize any part of the Bill of Rights.
They passed a law that is constitutionally incorrect.”
councilman Ken Marks questioned, “Do you have a Statue Number for that?”
Mr. James Demoruelle stated,’Tor that statement?”
Councilman Ken Marks stated, “Yes Sir.”
Mr. James Demoruelle stated, “I don’t have it right now. I will tell you that I just came
from the hospital due to surgery with my son and my thinking cap at 85 years old is not
what it used to be. I am a little bit slower but I will have it for you.’,
Councilman Ken Marks stated, “Okay thank you.”

Public Works Chairlady Nancy Carriere stated, “You look well for 85 years old
congratulations.”
Mr. James Demoruelle stated, “Thank you Ma’am and I take appointments.”
Public Works Chairlady Nancy Carriere stated, “I have a few questions. I did not rcalize
that was a big indust4r an5rmore.”
Mr. James Demoruelle stuted, “No one quit.”
Public Works Chairlady Nancy Carriere stated, “I did not know that so it became illegal is
that right?”
Mr. James Demoruelle stated,’It became illegal because of pressures from Animal Rights
Group. They have no consideration to our Constitutional Rights. When it happened then
we were not as aware as we are today. We are really aware today as to what has been
violated.”
Public Works Chairlady Nancy Carriere stated, “I understand that you are going to apply
for a permit, you want a license to be able practice, /rght?”
Mr. James Demoruelle statedr “That is what I would like, yes, Ma’am
Public Works Chairlady Nancy Carriere stated, “I am just curious to know how you would
want a license for something illegal. It is still illegal.”
Mr. James Demoruelle statedr’Running a restaurant is illegal without a license so we have
to ask for the license okay.”
Public Works Chairlady Nancy Catiere stated, ‘oI was thinking, don’t you think is should
become legal first and then you get your license.”
Mr. James Demoruelle stated, { say the law is illegal and that is why I wanted a
determination from the Attomey General. If she agrees with us and she would almost have
to then we could go to the Legislature and say look, let’s get this right.”
Public lYorks Chairlady Nancy Cawiere stated, “My next question is this: You said that
you were from Evangeline Parish.”
Mr. James Demoruelle statedr “Yes, Ma’am and we are from all over the state”.
Public Works Chairlady Nancy Caniere stated,’Tlave you tried in any other parish? Like
Evangeline Parish?”
Mr. James Demoruelle stated,’T{o Ma’am you are the first. We came here for a particular
reason. This was the birth place of the Sunset Game Club. An lnternationally known club.
People all over the world knew it and people from all over the world came to Opelousas and
stayed in your hotels and probably most of you all never knew it. For seven months out of
the year every weekend we can fill every room in this area and you would be the first.”
Chairman Jody White stated, “I will make a comment sir and Ms. Nancy touched on it.
With my being aLaw Enforcement Officer for 2l years I will say this. I think you are
slightly putting the wagon before the horse in which you need to take this fight up with our
Louisiana Legislature. If it could be overturned in the State it is a lot easier to come down
to the smaller govemment to get the permit to allow it to happen. I think what we will do at
this point we have your name and number on the card and I think tomorrow with our
attorney I will come back in and get with my clerk tomorrow and somebody will contact
you tomorrow just to touch base again but we will have to do a little bit of research because
I don’t know that law but I know of it.”

Mr. James Demoruelle stated, { would like to help you with it because we already have a
whole collection of research that I can share.”
Chairman Jody White stated, “Okay, so again with that being said there is no vote that will
happen tonight on a permit or anything of that nature but I will be happy to give you a call
myself tomoffow to see where it can go.”
Mr. James Demoruelle stated, “This what I was looking for tonight, thank you very much.”

  3. Discuss a form of caution on Jennings Road and HWY 742. (Coancilwoman Nancy
    Carriere).
    Public Works Chairlady Nancy Carriere stated, “I brought this up. I know Mr. Bellard
    that we talked about this and I know that we are not going to do any speed bumps. I just
    want to know if you could get with the State. It is a very, very high traffic area on HWY
    742 and Jennings Road at that cross section. People are traveling from all over because it
    is a short cut and it is very highly traveled. Maybe they could do some kind of study but
    there are a lot of accidents. I was informed today that they need to have some grass cut
    because it was kind of high, I was just informed about that tonight. Is there any way that
    we could see if they could place a caution light or something.”
    Parish President Jessie Bellard stated, “We will ask and maybe we can do something on
    Jennings Road like we did in District 11. It is ahead of time and you will have a sign with
    a flashing light that will be saying there is a stop sign ahead. We can do that but on the
    state road we can ask Brandon about that.”
    Public lV’orks Chairlady Nancy Carriere stated,’1 also want to ask about further down on
    HWY 742,I live off of BeBo and I know Mr. Ardoin brought up about Tom Schneider and
    HWY 31. I thought about putting reflectors and I cannot touch the signs or anything but
    something to see off of HWY 742. We have several roads that are off of HWY 742but
    BeBo is right before the curb and the church and it is sort of dangerous and the grass on the
    highway is high and I have called the state several times.”
  4. Discuss any other business properly brought before this committee.
    Public Works Chairlady Nancy Cawiere stated, “I do have one think I have to ask: Mr.
    Brown brought up the traffic off of I-49 getting on to HWY 190. Is there any way that we

can place trash cans on the corner of Gayo and Grolee and off I-49 and Creswell Lane so
we can have stationary trash cans.”
Parish President Jessie Bellard stated, “We can get with Richard LeBouef with the Solid
Waste and see if they can do something with that. The parish cannot do anything on the
state but Richard may be able to supply them with something that they ca install.
Public Works Chairlady Nancy Cawiere stated, “It will just be a matter of collecting the
garbage once it is there. It is a lot better than tying a trash bag to the sign.
Chairman Jody White stated, “I happen to be friends with one of the supervisors at DOTD
and I ask questions like that all of the time. If we as Parish Government or Richard
LeBouef install trash cans or anything of that nature they are not going to maintain it. It
will still be on somebody to go out there.”
Public lV’orks Chairlady Nancy Caniere stated,’l think it would be mainly on Mr.
LeBouef because it is at a stop sign. It is at the Parish advantage to have something
because it gets really built up. It maybe something that we would have to maintain.”
Councilman Wayne Ardoin stated, “You were talking about HWY 742. HWY 142 when
you want to get off of Jennings Road onto HWY 742 and you look to your right to get onto
the highway. There is a blind spot there. There is a Cider Tree in the way and the state
needs to Boom-Ax. It is your district and I passed there this morning. It is a bad comer
and they have had numerous wrecks there so ask the state to please boom ax it. Ask them
to send a letter. They have had3-4 wrecks recently.”
