AN ORDINANCE TO AMEND ST. LANDRY PARISH ORDINANCE CHAPTER 44,
SECTION 44-14 so that Chris Road, Clarence Cormier Road, and Domengeaux Road in
Opelousas, LA can be included on the list of roads in St. Landry Parish that are designated
as “No Truck or 18-Wheeler Thru Traffic” routes.
WHEREAS, St. Landry Parish Ordinance Chapter 44, Section 44-14 lists the roads in St. Landry
Parish that are designated as “No Truck or 18-Wheeler Thru Traffic“ routes.
WHEREAS, this Ordinance amends St. Landry Parish Ordinance Chapter 44, Section 44-14
so that Chris Road, Clarence Cormier Road, and Domengeaux Road in Opelousas, LA can be
included on the list of roads that are designated as “No Truck or 18-Wheeler Thru Traffic“ routes.

ORDINANCE NO. 2025-019
(Sponsored by Councilman Faltery Jolivette)

An Ordinance to Amend the Procedures for Collection of Charges for St. Landry Parish Government’s
Abatement of Nuisance Violations, by Mandating the Charges 1) be Added to Annual Ad Valorem Tax Bills
by the Tax Assessor or Tax Collector, and 2) be Collected by the Tax Collector.

 WHEREAS, the St. Landry Parish Code Sections 26-24 and 26-28 provide the procedures by
which charges are collected for St. Landry Parish Government’s abatement of nuisance violations;

 WHEREAS, the St. Landry Parish Government has incurred and continues to incur costs related
to the abatement of nuisances on properties, for which governmental liens are filed and recorded
on the property;
 WHEREAS, the St. Landry Parish Government wishes to amend St. Landry Parish Code Sections
26-24 and 26-28 to mandate that the nuisance abatement charges be added to the annual ad valorem
tax bills of properties involved if the charges remain unpaid; and,
 WHEREAS, Louisiana Revised Statute Section 33:4766 provides:
The parish or municipality has a privilege and lien upon an immovable and its improvements,
and the owner is personally liable for… cost to the parish or municipality of maintenance of the
immovable or improvements[.]… “Maintenance” shall include but not be limited to grass
cutting, weed abatement, and trash and garbage removal.


[T]he privilege and lien may be enforced by assessing the amount of the privilege and lien
against the immovable as a tax against the immovable, to be enforced and collected as any
ordinary property tax lien to be assessed against the property; the lien and privilege may be
collected in the manner fixed for collection of taxes and shall be subject to the same civil
penalties for delinquencies. After the parish… has incurred such costs as constitute the lien and
privilege on the property, the parish president… may send an attested bill of said costs and
expenses which constitute the lien and privilege to the director of administration or tax assessor
of the parish in which the property is located, who shall add the amount of the bill to the next
tax bill of the owner.
 WHEREAS, Louisiana Revised Statute Section 33:1236(21)(a)(i) provides, “Parishes may, at their
option, pass ordinances to add grass cutting charges as heretofore enumerated to the annual ad
valorem tax bill of the property involved if the charges remain unpaid; the ad valorem tax lien
imposed thereby and such rights attendant thereto shall coexist with those granted under this Item.”

BE IT ORDAINED BY THE COUNCIL FOR ST. LANDRY PARISH GOVERNMENT THAT
Section 26-24 in Chapter 26, Article II, in the St. Landry Parish Code of Ordinances is hereby
amended and shall now read as follows:
Sec. 26-24. – Liability for costs when parish government does work; collection.
The actual cost to the parish government including reasonable and required administrative charges
of having work performed pursuant to the provisions of this article is declared to be a charge, cost, or
expense of the property abutting the sidewalk or banquette, or of the lot, place, or area, where such
noxious weeds, grass, deleterious, or unhealthy growths have been cut, destroyed, or removed.
Such costs and expenses shall be collected in the manner fixed for the collection of taxes and shall
be subject to the same penalties for delinquencies. The Parish President or his designee shall cause
the demand of the owners of such property the payment of such charges, costs, or expenses. After
the cutting, destruction, or removal of such weeds, grass, or growths as shall have been done by the
public works department, after due notice as stated in section 26-23, if the costs or expenses thereof
shall not have been paid within 30 days after demand, the Tax Assessor or Tax Collector shall add
the amount of the bill to the next tax bill of the owner. The Parish President or his designee shall also
have recorded within 60 days from the date of completion of the cutting or removal in the mortgage
office of the parish an attested bill showing the cost and expense incurred for the work and the place
or property on which the work was done, so as to establish for the parish government a lien and
privilege securing the payment of the property owner of the charges, costs, expenses, and legal
interest on such amounts from the date of recordation.
BE IT FURTHER ORDAINED BY THE COUNCIL FOR ST. LANDRY PARISH GOVERNMENT THAT
Section 26-28 in Chapter 26, Article II, in the St. Landry Parish Code of Ordinances is hereby
amended and shall now read as follows:
Sec. 26-28. – Collection of charges when parish government abates violation.
a. The actual cost to the parish government, including reasonable and required

XI. RESOLUTIONS TO BE ADOPTED:

RESOLUTION NO. 015-2025

WHEREAS, Darnall, Sikes, and Frederick, a Certified Public Accountant Firm, performed
an independent financial audit of St. Landry Parish Government.
BE IT RESOLVED, by the St. Landry Parish Council, that the independent audit
performed by Darnall, Sikes, and Frederick of St. Landry Parish Government, which is
dated July 16th , 2025, is accepted.

RESOLUTION NO. 016-2025

A resolution approving the holding of an election in Fire Protection District No. 3
of the Parish of St. Landry, State of Louisiana, on Saturday, November 15, 2025,
to authorize the renewal of a special tax therein.
WHEREAS, the Board of Commissioners of Fire Protection District No. 3 of the Parish of
St. Landry, State of Louisiana (the “Governing Authority”), acting as the governing authority of
Fire Protection District No. 3 of the Parish of St. Landry, State of Louisiana (the “District”),
adopted a resolution on June 24, 2025, calling a special election in the District on Saturday,
November 15, 2025, to authorize the renewal of a special tax therein; and
WHEREAS, the governing authority of the District has requested that this Parish Council,
acting as the governing authority of the Parish of St. Landry, State of Louisiana, give its consent
and authority for the District to hold the aforesaid election, and in the event that the election carries
to continue to levy and collect the special tax provided for therein; and
WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of
Louisiana of 1974, it is now the desire of this Parish Council to approve the holding of said election
and in the event that the election carries, to authorize the District to continue to levy and collect
the special tax provided for therein;
NOW, THEREFORE, BE IT RESOLVED by the Parish Council of the Parish of St.
Landry, State of Louisiana, acting as the governing authority of said Parish, that:
SECTION 1. In compliance with the provisions of Article VI, Section 15 of the
Constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of
Commissioners of Fire Protection District No. 3 of the Parish of St. Landry, State of Louisiana,
this Parish Council hereby approves the holding of an election in the District, on Saturday,
November 15, 2025, at which election there will be submitted the following proposition, to-wit:

PROPOSITION
(MILLAGE RENEWAL)

Shall Fire Protection District No. 3 of the Parish of St. Landry, State of Louisiana
(the “District”), continue to levy a special tax of 10.36 mills on all property subject
to taxation in the District (an estimated $2,636,000 reasonably expected at this time

to be collected from the levy of the tax for an entire year), for a period of 10 years,
beginning with the year 2026 and ending with the year 2035, for the purpose of
constructing, maintaining and operating the District’s fire protection facilities, and
paying the cost of obtaining water for fire protection purposes, provided that a
portion of the Tax proceeds is required to be contributed to state and statewide
retirement systems as provided in R.S. 11:82?
SECTION 2. In the event the election carries, this Parish Council does hereby further
consent to and authorize the District to continue to levy and collect the special tax provided for
therein.

ADMINISTRATIVE/FINANCE COMMITTEE MEETING MINUTES

  1. Administrative Finance Chairman Harold Taylor called this meeting of the
    Administrative/Finance Committee of the St. Landry Parish Council to order.
  2. Councilwoman Vivian Olivier led the Pledge of Allegiance & Invocation.
  3. Roll Call: Faltery Jolivette, Harold Taylor, Ken Marks, Timmy Lejeune and
    Ernest Blanchard. ABSENT: Ex-Officio Jody White and Dexter Brown.
    *Councilman Dexter Brown was absent for roll call but later joined the meeting.
  4. Person to address the Committee.
     Mr. Steve Moosa – Audit Report
    Mr. Steve Moosa, Auditor addressed the council. He stated, “Good evening council.
    Tonight I will go over the Financial Audit for the calendar year of 2024. I have met with
    many of you in the past month. I will go over it in detail for those of you who wanted to
    get an in depth detail and have questions regarding the Audit Report, so to night I will go
    over it. We are engaged by you as the council and approved by the Legislative Auditors
    to conduct the Audit for the organization because of the Federal Dollars and State Dollars
    you receive and public funds. On Page 1-3 of the report is our Independent Auditor’s
    Report. We give a clean opinion for the parish for the calendar year of 2024. We were
    able to complete the audit timely. It was due within 6 months of the year. It was mailed
    to the Legislative Auditors in June after being approved by the management by the
    president and his staff that gave us the okay. Tonight I am presenting it to you and you all
    have the opportunity to receive and accept the report. It is just a formality that we have to
    make sure that you all are aware that the reports were finalized and you all have the
    opportunity to see the report. I will jump all the way to page 14 and page 15 in the report.
    This is the revenue and expenses for the parish for the calendar year of 2024. I will tell
    you the total revenue for the parish in the year was almost $40,000,000.00. It was
    $39,900,000.00. In this past year we received roughly $10,000,000.00 of grants between
    the Federal Government and the State, $8,000,000.00 came from the Federal Government
    with 20% of your revenue. $2,300,000.00 came from the State of Louisiana with about
    6% of your revenues. Besides that your local revenue like your property taxes you took in
    about $6,000,000.00 and that represents about 15% of your total revenue. The sales tax
    collected by the Parish Government was just under $11,000,000.00 and that is set aside for
    Capital Improvements, your road program and paying off debt that was issued as far as the
    safe home plan that was done in 2014. Your Sales Tax Revenue represents about 28% of
    your revenues. We looked at your Slots and Racino Tax Revenue combined and that is
    about $4,000,000.00 or roughly 10% of your revenue. You do provide some of the Racino
    Slot Tax to the Municipalities and other organizations within the parish. It is about
    $1,000,000.00 that you hand out to assist them with their operations. Those Revenue
    Sources describes property tax, sale tax, slot tax, federal grants and state grants that

represent about 80% of the revenue of the $40,000,000.00 received in the year. When I
look at the expenses for this calendar year, the total expenses were $42,400,000.00, of that
$6,000,000.00 was for Debt Services. That is paying on the bonds that were issued back
in 2014. Those bonds total about $62,500,000.00. There were 15 year bonds and we are
now 10 years into that. We actually have 5 years left. They mature in 2029 so actually 4
years from now. The outstanding balance on those bonds today is about $22,000,000.00
and they were originally about $62,000,000.00 so they have paid down about
$40,000,000.00 in the last 10 -11 years. The Sales Tax Revenue that I mentioned earlier
that is used to pay these bonds, the Sales Tax Revenue was $11,000,000.00 and your Bond
Payments were just under $6,000,000.00 so that left you all an excess of $4,000,000.00 for
the Road Program and for your current needs and so forth. The Grant Money that came in
which is about $10,000,000.00 that is mostly with the WIOA Program. They received
about $5,400,000.00 and spent that during the year. You have your Community Action
that receives about $1,000,000.00 and they spent that during the year and that is including
the $42,000,000.00. The Governmental Expenditures total about $13,000.000.00 and that
includes Mandated Expenses which were at least $4,400,000.00 this past year. That
expense is helping the other organizations within the parish like the Clerk of Court, DA
Office and the Sheriff that is mandated by State Law. Public Safety and Public Works
total about $10,000,000.00 of Expenditures. Health and Welfare totaled about
$2,400,000.00 and Capital Outlay for the year is about $4,200,000.00 or 10% or your
expenditures in the current year. With Revenue of $40,000,000.00 coming in and
expenses of $42,000,000.00 you had and excess of Expenditures over Revenues of
$2,500,000.00 and that was absorbed by prior year fund balance for monies received in
prior years that were used to cover the shortfall of revenue in the current year. You will
remember in 2021 – 2022 you collected a lot of COVID Money from the Federal
Government and those monies are still available within the Parish Operations and used to
offset some of the Expenditures in the current year. What you have left in Fund Balance
is about $6,500,000.00 which represents about 16% of your revenue in the year. So Fund
Balance is money that you have left over to carry over to next year to cover expenses as
well as the current revenues that is coming in but 16% represents about 2 months of
cushion and that is with the Government as a whole in total. In the General Fund you
have about $500,000.00 of Fund Balance in reference about 5% of your Revenue for the
year. The Health Unit has about 30% of its Annual Revenue left in Fund Balance. The
Road District Sales Tax Fund has about $2,400,000.00 sitting in its Fund Balance with
Revenue of $11,000,000.00 so it has about 21% of its Annual Revenues in Fund Balance.
It just gives you an idea of where the Parish stands as of December 31, 2024. The
majority of the report starting on page 18 – 49 are Note Disclosures. They are required for
the Accounting Standards to be presented. It talks about all of the Accounting Policies
and Procedures. It describes the detail and the balance sheet and the revenue expense
categories. I mentioned the Debt Outstanding and that is note number 9 and that would be
on page 38. On page 37 is the 5 year payout, the remaining 5 years that we have on the
Bond Insurance for the Revenue Bond Series 2014. I mentioned that we have the
Principal Balance on those bonds of $22,600,000.00 with a remainder of $2,200,000.00 of
interest over the next 5 years and those bonds will be paid in full. I will jump to the back
of the report, in addition to the Financial Record we presented to you all we looked at the
Internal Control Recommendations we may have for policies, procedures or laws or so
forth that we see that maybe were not followed. We present them and it is recommended
that you take action to alleviate those short comings in the coming year. On page 89 and
page 90 you will find what we call Internal Control and Compliance, findings for the year.
The first one on page 89 is the Budget Variance. You adopt a budget each year and it is
presented by management. The council adopts it and your state law say you must
maintain a 5% or less Variance in those funds. Several of those funds this year, the
Airport, Road and Bridge and the Road District Sales Tax Fund Revenue and Expense or
Expenses Exceeded budget by 5% so we presented that here. We also had as part of the
Audit trying to decide what goes in the General Fund and what goes in the Health Unit,
the General Maintenance or so forth inter-fund activity we know there is a lot of coding
changes that we had to make during the audit through our Journal Entries so we
recommend to management to take steps to alleviate or reduce the number of miscoding
data going in. If it is miscoded it is not as reliable as once it is coded properly you can see
where things are. That probably attributed to the budget variance that we saw in the audit.
On page 91 there were a couple of findings related to the budget adoptions and the notice
of Public Hearings. When we saw that this year when you are presenting the budget for

adoption you must give a 10 day notification in the newspaper. We saw that there was
only a 6 day prior to the meeting that the budget was adopted that was actually published.
State Law says that you must have a 10 day window for publications. The Budget was
late this past year. Both the State Law and your Charter states a specific date that it must
be adopted and it was not adopted by that date so we are just reminding you to try to make
every effort to adopt your budget timely for planning purposes. That is what I have for
you tonight for presentation. Are there are any questions?”
Administrative Finance Chairman Harold Taylor questioned, “On Page 87 under
Section 1, Internal Control and Compliance Material to Financial Statements, 2023-001
Budget Variance, we had one in 2023 and it reoccurred in 2024 is that correct?”
Mr. Steve Moosa, Auditor stated, “That is correct.”
Administrative Finance Chairman Harold Taylor stated, “On 2023-002 miscoding we
had a problem in 2023 and we have another problem in 2024 is that correct?”
Mr. Steve Moosa, Auditor stated, “It was a subsequent following, yes.”
Administrative Finance Chairman Harold Taylor stated, “2023-003 it looks like we
satisfied that is that correct?”
Mr. Steve Moosa, Auditor stated, “Yes, we had a finding in 2023 dealing with
Intercompany Reconciliations, Inter-fund Reconciliations and that was resolved, yes.”
Administrative Finance Chairman Harold Taylor stated, “Okay, 2023-004, Maintenance
of Accounting Records and Support Schedules, have that finding have been resolved for
2023?”
Mr. Steve Moosa, Auditor, “Yes that is correct.”
Administrative Finance Chairman Harold Taylor stated, “Okay, in 2023-005 Public
Notice Hearings of course we had a problem in 2023 and it reoccurred in 2024 is that
correct?”
Mr. Steve Moosa, Auditor, “Yes.”
Administrative Finance Chairman Harold Taylor stated, “That is all of my questions on
that particular issue.”
Mr. Steve Moosa, Auditor, “Okay.”
Councilman Ken Marks questioned, “Mr. Moosa, thank you for coming here. Mr.
President are we are completely acclimated to the new system now that have been in place
for 4 or 5 years now?”
Parish President Jessie Bellard stated, “Oh no it has only been a little over 1 year.”
Councilman Ken Marks stated, “Okay.”
Parish President Jessie Bellard stated, “But it is fully operational.”
Councilman Ken Marks stated, “Okay and everything is on line for coding and these
findings that we are seeing they should go down I would think.”
Mr. Steve Moosa, Auditor stated, “Yes, the last two years was implementation of the
Software that was occurring. This would be the first full year.”
Councilman Ken Marks stated, “That is what I am getting at, great, good to hear. Thank
you.”

th, 2025. We will be bringing that to
you all to bring it to the full council for approval to sell these properties at the highest
bidder. You all should have a copy so if I can get a motion to send it to full council. On
this one we only had 11 properties but the next one in September will have 40 plus
properties.”
A motion was made by Councilman Timmy Lejeune, seconded by Councilman Ernest
Blanchard to forward to Regular Meeting held on Wednesday, July 16th, 2025 to
authorize the Parish President to go forward with the sale of 11 Adjudicated Properties.

we will have a meeting with the Mayors of the Parish and we are inviting you all to come
as well regarding the FEMA Guidelines and the changes that are being made. We want
to make sure that everyone is aware of them because the Municipalities don’t report to us
then they won’t get anything. It is getting to where they have to do their part to get their
own money back. We want to make sure that it is clear and they understand the new
rules. We wanted you all to be present if you all want to be there to listen to what the
new rules are going to be and hopefully we can go without having to use them this year.”
Councilman Ken Marks questioned, “Where is it held?”
Parish President Jessie Bellard stated, “At the Delta Grand at 11:30 a.m. next Thursday,
July 10th, 2025.”

Mr. Bellard a couple of weeks ago at a meeting I asked about the Budget Overrun of
$375,000.00 and you said that you were going to have a meeting to inform us about it and
that have not happen, have you decided on a time that we will get to talk about this?”
Parish President Jessie Bellard stated, “No I haven’t but we are making some more
changes. I will do everything at one time and I will have one meeting or a couple of
meetings, but we are not finished.”

Councilman Ken Marks questioned, “Mr. President we had put something forward to the
Economic Development Board to kind of change their statue to make sure that they
would approach us prior to any new taxes being applied to any of our constituents.
Where are we with that right now?”
Parish President Jessie Bellard stated, “The bylaws, they sent us a copy of them about
two weeks ago and I sent them to Lance so we can make sure that is what we need. Their
main objective is to make sure that they come to this body and make everybody aware of
what is happening with any types of Economic Development deals that are coming up.
That is the just of it. Even though they say that it is in their bylaws and they don’t do it
we can’t make them do it because the laws allows them to do it but they feel that they can
put it in their bylaws and they are going to adhere to it.”
Councilman Timmy Lejeune questioned, “Mr. Bellard, my understanding is that we did
make some layoffs in the parish.”
Parish President Jessie Bellard stated, “That is correct.”
Councilman Timmy Lejeune continued, “To the tune of how many dollars do you think
that is? Not how many people but actually how many dollars?”
Parish President Jessie Bellard stated, “I don’t know the exact dollar amount but the
changes that we made in operations was $374,000.00 for this year.”
Councilman Timmy Lejeune stated, “Okay, thank you.”
Councilwoman Nancy Carriere questioned, “I just wanted to know how successful the
Bar-B-Que Cook-off was this year?”
Parish President Jessie Bellard stated, “It was very successful for the parish. We were
able to meet our budget and still provide everything we needed. The sponsors are the real
heroes in this one. Without the sponsors we cannot put it on.”
Councilwoman Nancy Carriere questioned, “Are you planning on doing anything for
July 4th, 2025? I know normally you do.”
Parish President Jessie Bellard stated, “We have a fireworks display Friday night at
9:00 p.m.”
Councilwoman Nancy Carriere questioned, “Is it on Facebook? I don’t have Facebook
so that is why I am asking.”
Parish President Jessie Bellard stated, “Yes it is on Facebook. We put it out last week.”
Councilman Timmy Lejeune questioned, “We had that Bar-B-Que Fest a couple of
weekends ago, can you tell me how much money the Parish had to spend to have this
activity put on for the people of St. Landry Parish and abroad? Tax Payer money
Mr. Bellard.”
Parish President Jessie Bellard stated, “I would have to look at it. The overall cost of
the Bar-B-Que Festival I want to say was around, I don’t want to lie to you, eighty
something, I will tell you what I will do. I will have a copy for you all because I am not
exactly sure of the overall cost. They are working on those numbers now.”

  1. Explanation of Capital Outlay. (Councilwoman Mildred Thierry).
    Councilwoman Mildred Thierry stated, “Mr. Bellard, after you appeared on two different
    news channels, one last week and one the week before and it was mentioned something
    about funds and I think some constituents did not get the full segment of what was being
    said so I thought that maybe you could give a little explanation, hopefully some of them
    are listening.”
    Parish President Jessie Bellard stated, “So this year we asked for $1,500,000.00 for the
    Eunice Community Health Center. The building that we kept up at the old hospital, we
    are going to re-do that building and we will be able to make at least 4 offices in that
    building. One office will be for the Eunice Community Health Center. That is
    $1,500,000.00 of Appropriated Money which means it is coming in as cash, it is not a
    match so you get the whole $1,500,000.00 and that is for that purpose. We also had the
    remainder of our $1,000,000.00 for Bayou Mallet and Bayou Carron. It was re-assigned,
    it has to be redone everyone year but we are at the end of that one. I am not exactly sure
    how far we have left on Bayou Carron but we do have a $107,000.00 and some change
    that is not allocated left that we are going to re-allocate to do more of Bayou Carron and
    hopefully come close to finishing it. We have $2,600,000.00 this year for Nap Lane from
    HWY 182 to Riverbirch, maybe. So that $2,600,000.00 is a lot of money for a short
    piece of road but we have to widen the road and we have to re-do the drainage and we are
    adding another turning lane on Nap Lane for HWY 182 so we can get better access to
    HWY 182. That was in priority one which mean it is for 2025 – 2026. In priority five
    there is $2,400,000.00 for next year to go from Riverbirch to Lewisburg Road. That one
    won’t be as expensive because we are not widening the road much. We are just
    overlaying it so it will be a little easier. Now keep in mind we did not receive none of this
    money yet.”
    Councilwoman Mildred Thierry stated, “That is what I was about to ask you to explain
    because that is what they were confused about. They think that we actually received this
    money.”
    Parish President Jessie Bellard stated, “When I say we got the money I mean that we
    applied and we were granted the money but it is a process. We probably won’t get this
    money until next year sometimes and that is if the Bond Commission approves it and the
    Governor signs and everything else but it is looking pretty good. We also got
    $300,000.00 for a study to be done on Bayou Des Cannes which is in the Eunice area.
    That is basically going to give us the opportunity to understand why it floods so much on
    that end. That will be a joint operation between us, Evangeline and Acadia Parish. So
    that is $300,000.00 for that one. On the Federal level Senator Bill Cassidy had brought
    $900,000.00 to Committee, it came out of Committee for a new Hanger at our Airport,
    another big Hanger. We have 30 plus planes on the list to be housed and we don’t have
    enough space so that is a plus. Senator John Kennedy has put in $900,000.00 for
    drainage. That one did not get to Committee yet but we feel confident that it will pass
    Committee. All of this is stuff that we are told that is going to be happing and it is
    pending but we don’t get it until it is done, until it is ready to go. That could be 2026
    sometimes 2027. We are just finishing up a project over there at the airport that we
    received approval on in 2022, so we are in 2025 and we are just finishing up with that
    project. It takes a while for that money to come down on any Federal or State level.”
    Councilwoman Mildred Thierry stated, “Thank you.”
  2. Discuss any other business properly brought before this committee.
    Councilman Timmy Lejeune questioned, “Mr. Bellard, the funding for Nap Lane, I
    know that it is on its way but it has not got here yet. No construction is going to start
    until 2026, am I understanding that because the funding won’t get here until probably
    the end of 2025.”

Parish President Jessie Bellard stated, “Yeah, I don’t see construction starting until next
year. We are already ahead of the game believe it or not on the Planning and
Development. The Engineers did some work on that this year with one-hundred and
something thousand that we had appropriated from last year. They are ahead of the game
but they still have to do a lot more because of the right-of-ways, utilities, relocation and
different things. I don’t see construction starting until 2026.”
Councilman Timmy Lejeune questioned, “I know that it has been announced now in this
meeting. It is publically said that it won’t start until 2026 but I guess I am going to ask
you if there is any way that we can put this on the Facebook Page of the Parish
Government or something because we are getting a lot of calls on that. I know that the
funding was suppose to come in a whole lot earlier and it was delayed and we are just
finding that out so maybe we need to make it known to the public that it is coming back
up.”
Parish President Jessie Bellard stated, “Okay, we can do that.”
Councilman Timmy Lejeune stated, “Okay that would be great.”
Councilman Ernest Blanchard stated, “Mr. Bellard, Nap Lane, is any part of that will
come out of the Smooth Ride Home Program?”
Parish President Jessie Bellard stated, “Yes we will have to put up what I think is
$300,000.00 of the Smooth Ride Home Money to match for that program.”
Councilman Ernest Blanchard stated, “Because it is out of the city limits.”
Parish President Jessie Bellard stated, “Oh yes that is out. Yes Sir.”
Councilman Dexter Brown questioned, “On Nap Lane, on the South side of Nap Lane,
will there be any tree removal? I know that the trees are just right there.”
Parish President Jessie Bellard stated, “Yeah if I am not mistaken talking to the
engineers that was one of the things that was going to be a problem especially when you
go closer to Riverbirch. They have some large trees that need to come down which is
going to be a good thing for safety reasons as well.”
Councilwoman Nancy Carriere questioned, “You did not mention and I also saw this on
TV and I think someone asked me about it and they were all excited about the city jail
which is not Opelousas City Jail, is it going to be in Eunice, correct?”
Parish President Jessie Bellard stated, “Right, Eunice, the City of Eunice received I
want to say $1,200,000.00 or $1,300,000.00 and that is for the jail in Eunice, the Eunice
City Jail. That is for the City of Eunice.”

  1. Public Works Chairwoman Nancy Carriere called this meeting of the Public Works
    Committee of the St. Landry Parish Council to order.

    and Jimmie Edwards. ABSENT: Ex-Officio Jody White.
  3. Person to address the Committee:
    Ms. Flo Hammond addressed the Council. She stated, “Good evening. I am Flo
    Hammond. I live at 1939 Johnson Street. I am the President of Gravity Drainage District
  4. The whole Drainage Board is here on behalf of Mr. Larry Davis who lives at 8342
    HWY 182. He has been having some issues with drainage on his property for about 1-
    1/2 years. We have talked to Mr. Barry Soileau and there were suppose to be some funds
    from last year Mr. Bellard and you all ran out of funds. It is an issue with that property
    on Daisy Lane. The drainage district does not have heavy equipment and we cannot fix
    the problem because we don’t have access to the machinery that it needed to fix the
    problem. We just want you all to be aware that this have been ongoing for about 1 1⁄2
    years. Mr. Davis’s property and the property behind Piggly Wiggly which is Daisy Lane
    needs some heavy equipment to come in and get it taken care of.”
    Public Works Chairwoman Nancy Carriere questioned, “You spoke to me and I did not
    understand where Mr. Davis lives.”
    Ms. Flo Hammond stated, “He lives at: 8342 HWY 182.”
    Public Works Chairwoman Nancy Carriere stated, “If I am not wrong I think HWY 182
    is the state and any ditching have to be done through the state.”
    Parish President Jessie Bellard stated, “Is this the back section of his house. I am
    familiar with it. I was trying to remember. That goes into the City of Opelousas.”
    Ms. Flo Hammond stated, “No Sir, no.”
    Parish President Jessie Bellard stated, “That is not the same one that we looked at when
    it goes behind Daisy like the Old Lumber yard.”
    Ms. Flo Hammond stated, “Yes, that is.”
    Parish President Jessie Bellard stated, “So it goes into the subdivision, Indian Hills
    Subdivision.”
    Ms. Flo Hammond stated, “No, no.”
    Parish President Jessie Bellard stated, “Not that one.”
    Ms. Flo Hammond stated, “No Piggly Wiggly. It is behind Piggly Wiggly off of Daisy
    Lane. It is adjacent to the property behind Piggly Wiggly. There is a canal that runs
    between his property and another gentleman’s property and that gentleman is also having
    drainage issues but he could not come tonight so it is that canal.”
    Public Works Chairwoman Nancy Carriere stated, “I thought when you said HWY 182
    but the property is in the back.”
    Ms. Flo Hammond stated, “That is his address but it is our canal, a parish canal.”
    Parish President Jessie Bellard stated, “What I am saying if I am not mistaken that is the
    same canal that ends up into the City of Opelousas and Indian Hills. We went and look at
    it and there is a lot of drainage problems on that canal.”

Ms. Flo Hammond stated, “Ms. Winters is saying it does.”
Parish President Jessie Bellard stated, “That is that same one that we looked at and we
talked about doing some stuff on that canal. I will have to get with the Mayor. Even if
we do anything it is going to get stopped in the city. We can work with the mayor on this
one.”
Ms. Flo Hammond stated, “Okay awesome. If you guys would let the Drainage Board
introduce themselves. We just got renewed. The St. Landry Gravity Drainage District
No. 14 Members introduced themselves: Mr. Howard Jolivette, Ms. Eva Noel, Ms. Mary
Daigle and Ms. Beverly Reynolds.”
Councilman Wayne Ardoin questioned, “Do you all turn in an Audit Report to Parish
Government?”
Ms. Flo Hammond stated, “Yes.”
Councilman Wayne Ardoin questioned “Mr. Bellard do you receive any?”
Parish President Jessie Bellard stated, “It comes to the council.”
Councilman Wayne Ardoin stated, “I have never seen one. Now, you all don’t have any
equipment at all?”
Ms. Flo Hammond stated, “No, we do not.”
Councilman Wayne Ardoin stated, “You all had a tractor at one time and you all got rid
of it.”
Ms. Flo Hammond stated, “Right, it was not working so we did get rid of the tractor.”
Councilman Wayne Ardoin questioned, “Do you all have any kind of equipment to do
weed control or dig anything?”
Ms. Flo Hammond stated, “No Sir, we contract out.”
Councilman Timmy Lejeune questioned, “What is your annual revenue?”
Ms. Flo Hammond stated, “Our Annual Revenue, I can’t give you the exact numbers but
it is between $33,000.00 and $36,000.00.”
Public Work Chairwoman Nancy Carriere questioned, “What do you all have left in
your budget?”
Ms. Flo Hammond stated, “I don’t have that number but our Secretary Ms. Virginia
Jones would have that information. We have spoken to a contractor and it would be more
money than we take in one year to clean it. Thank you guys for your time, thank you Mr.
Bellard.”
Mr. Howard Jolivette addressed the council. He stated, “Good evening. What I am here
to address is a violation and a lack of corrective action concerning the Twin Oak
Apartments which is at 8500 HWY 182 and the Dollar General Store. There is a sign
right now at the Twin Oak Apartments with violations on it but nothing have been done.
The signs have been there for about 2 months. The Twin Oak Apartments have
overgrown grass and unmaintained grounds. They have trash, sanitation and sewage
related issues. They also have frequent noises and reported gunfire. There is no visual
on sight security or resident safety measures at the Twin Oak Apartments. My other
concern is the Dollar General across from where I live. They have trash that have been
overflowing around the premises and uncovered dumpsters. They have sanitation issues
and the delivery trucks cause traffic blockage. They also have loud noises and
disturbances during the night and a lack of security and outdoor lighting. I come before
the board to file this complaint and hopefully the Parish Code Enforcement could do

something about this. I have contacted these departments and no action has been done. I
have contacted the state, the EPA. They commit violations but there is no corrections
done. I am hoping that someone can come out and take a look at it and see if any action
can be done.”
Parish President Jessie Bellard stated, “Mr. Jolivette, we are going to take care of what
we can. Some of that stuff is out of our jurisdiction but for the overgrown grass we are
going to follow up with that. I had to go there for the last flood and it is ridiculous. I
don’t know how people live like that.”
Mr. Howard Jolivette stated, “There is a sign right there. Code Enforcement put the sign
there. It has been there about 2 months and nothing have been done.”
Parish President Jessie Bellard stated, “We will go there tomorrow and follow up with
that one. The paper and the other stuff, we can do some stuff but the loud noise and the
traffic, I will ask the Sheriff’s Office, but we will do what we can on our end. As far as
the sewer we did pass an ordinance that allows us to do certain things with sewers
because of the state department. If you call the Board of Health they are going to ask you
about your sewer line first. So we took it upon ourselves to draft an ordinance so that
way we will be able to take care of that as well. We will look at that tomorrow.”
Mr. Howard Jolivette stated, “I have been working with the Louisiana Department of
Environmental Quality since 2009. They have had constant violations all of these years
and nothing have been done about it. I have a book long of records and nothing is being
done. I stay right next to it. Sewage overflows in my yard, you were out there.”
Parish President Jessie Bellard stated, “Yes Sir, we will follow up with it.”

  2. How much are we currently charging to cut lots and what is the possibility of
    spraying grass control on those lots? (Councilman Timmy Lejeune).
    Councilman Timmy Lejeune stated, “Mr. Bellard, the reason I bought this up is because
    I know in my district we have a lot of repeats, long grass and people are not taking care
    of their subdivisions and properties that they own. Some of this grass is about 6 feet tall
    and some of it is about 4 feet tall, there is just a lot going on. I don’t know how much we
    are charging to cut and I will use the word one acre lots, I don’t know how big they are
    but whatever it is if it is $100.00 or $300.00 is there any way that the first offense is
    $300.00 and the second offense is $800.00 and the third offense is $1,500.00 or we can
    go and spray it with Round-Up and kill all of their grass so we won’t have to go back for
    a long time. Something has to happen.”
    Parish President Jessie Bellard stated, “I agree but we can’t spray the grass and kill it
    because then they will sue us. The steps that we are taking now even if we charge
    $100.00 for a regular yard plus administrative cost and it goes up accordingly to the
    amount of time that we spend out on the property and everything else we are probably
    cheaper than a contractor would be. The difference is now in July we passed that
    ordinance that we are going to attach it to their tax sale. Whenever they come and pay
    their taxes they have to pay us back. I think once they start having to pay it they are
    going to start doing their own yard work. Trust me we charge them what we need to
    charge them within the reason that we can according to the ordinance but they are still not
    paying it. Now that this ordinance is going to pass hopefully then we are going to put it
    on the Tax Roll and either they are going to pay it or their property is going to be put up
    for the parish. It is unfortunate but we have to do that because we have so many repeats.
    If you look on HWY 190 by Ms. Cravins house that lot in between there that guy does
    not care. We tore the house down and we cleaned that property up and we have to cut the
    grass on a regular basis. He is not going to pay it. Now that we are going to put it on a
    Tax Roll he has no choice or we will sell the property and get our money back, some kind
    of way we will get our money back but before we did not have any mechanism in place
    but this will work for us I believe.”
    Councilman Timmy Lejeune questioned, “Who controls the volume of charges on
    there?”
    Parish President Jessie Bellard stated, “We follow the ordinance.”
    Councilman Timmy Lejeune stated, “It is part of the ordinance? Is there a law that we
    can’t charge them $300.00?”
    Parish President Jessie Bellard stated, “I will have to look at the ordinance again but if
    we follow the ordinance we can change the ordinance that is not a problem.”
    Councilman Timmy Lejeune stated, “I know that we only have a few months left in this
    year and the Tax Roll is going to come out and it is on there if there are any reasons that
    we have a repeat next summer with a lot of these properties then I think that did not shake

them up enough. We may have to really, really shake them up a lot. In my opinion the
same people that are shredding grass are the same people who are shredding grass on the
shoulder and they are the same people who may go out and clean out a culvert. Therefore
they are taking services away from people for little money that is well needed throughout
the parish.”
Parish President Jessie Bellard stated, “I tell you what I am going to do. I will pull that
ordinance and we are going to look at it and then we will make sure that you all get a
copy of it so you all can look at it. If you all think that we can change it and make it
stricter I am all in favor because that is going to slow down a lot of our calls.”
Councilman Timmy Lejeune stated, “That would be great, thank you.”
Councilman Alvin Stelly questioned, “They have been spraying in my District but they
have some of those roads will be lost if they are continued to be sprayed. Like on Seven
Arpents Road they have a Coolie that follows, it is washing underneath the road right
now.”
Parish President Jessie Bellard stated, “Okay, there suppose to be a Bermuda Release
Program where the good grass stays but evidently it is not working.”
Councilman Alvin Stelly stated, “No, we tried that on our Coolie in our District and we
had to quit that. I have another problem. I keep bring it up, Mushroom Road. I am
getting complaints about that. He parks his trailer on the road at night and blocks one
half of the road.”
Parish President Jessie Bellard stated, “I can call the Sheriff’s Office on that part or I
can get Spencer to go.”
Councilman Alvin Stelly stated, “What are we going to do with the trash? I wish you
would see that. Did you go there lately?”
Parish President Jessie Bellard stated, “Not lately, no I did not.”
Councilman Alvin Stelly stated, “Oh my God, it is unreal.”
Parish President Jessie Bellard stated, “We already did all the process on that one and
Barry’s people went out there.”
Councilman Alvin Stelly stated, “That is 3 years that we have been fighting that Jessie.”
Parish President Jessie Bellard stated, “I know. That is one of those repeaters that just
never stops.”
Councilman Alvin Stelly stated, “What do we need to do? We can’t do nothing with it?”
Parish President Jessie Bellard stated, “We are going to have too. It is just a matter of
pushing envelopes down the road. We will get on it and I will get with Barry.”
Councilman Alvin Stelly stated, “The neighbors are getting fed up with that.”
Parish President Jessie Bellard stated, “I don’t blame them, I don’t blame them.”
Councilman Wayne Ardoin stated, “We have an ordinance in the works right now as far
as assessing people with the taxes.”
Parish President Jessie Bellard stated, “Yes sir it should be in the July meeting I believe
for the adoption.”
Public Works Chairwoman Nancy Carriere questioned, “I have no problem with us
fining people when they don’t cut their grass but my question concern is this: With all of

the rain and sometimes we have an entire week of rain and they can’t get on their
property are we making exceptions for things like that?”
Parish President Jessie Bellard stated, “Definitely, the ones with the most complaints
are the ones that have the weeds taller than the grass and it has been longer than just the
rain.”
Public Works Chairwoman Nancy Carriere stated, “I know at one time we had a height
limit.”
Parish President Jessie Bellard stated, “It is in the ordinance. I want to say it is 2 feet.
It depends. If it is considered to be a hay patch then we don’t do anything about it but
most of the time we have the weeds that are growing taller than the grass is because they
are not taking care of it.”
Public Works Chairwoman Nancy Carriere stated, “I don’t have a problem with any of
that I am just asking you to clarify it. The last thing is this, I live in a subdivision and
there are empty lots, we are not concerned about farm land because we know that they
are trying to grow hay.”
Parish President Jessie Bellard stated, “If it is considered to be hay yes but if it is not
hay we take care of it.”
Public Works Chairwoman Nancy Carriere stated, “If it is in a subdivision can you let
us know what the height is. I have people calling me all the time and it maybe just one
foot high but their grass is manicured and they want their neighbors grass to be
manicured to 2 or 3 inches and you just can’t do that. That is why I wanted to know the
height limit.”
Parish President Jessie Bellard stated, “I will get you a copy of it so we can make sure, I
forgot. It is either 18 inches or 24 inches depending on where it is located. I am not
exactly sure but we will find out and we will get it to you tomorrow.”
Public Works Chairwoman Nancy Carriere stated, “Lastly, since we are talking about
the grass Ms. Beverly wanted to mention it tonight but since she is gone I will mention it.
Off of Plantation Road and HWY 182 but mostly on Plantation, I have called the state but
if you can call them I would appreciate it for HWY 182 there are chairs by Angie in the
ditch, a plastic chair and they have tall grass and it is bad. I called the state several times
and I was going to make another call but if you all can call too that would be great.
HWY 182, the drainage is poor on both sides and I don’t know if anyone sees the other
side.”
Parish President Jessie Bellard stated, “It is unfortunate but that kind of stuff we can go
and pick up ourselves but on HWY 167 and HWY 182 the drainage is horrible there.”
Public Works Chairwoman Nancy Carriere stated, “It needs to be cleaned because right
now it is slushed and it is bad. The last thing is on Country Ridge, I got a call today
about trees that fell. People are picking them up but they are throwing them in the ditch.
So there are big limbs on Country Ridge and check on HWY 182 and on Plantation Road.
Plantation needs to be cut.”
Parish President Jessie Bellard stated, “That won’t be a problem.”
Public Works Chairwoman Nancy Carriere stated, “I want to clarify this because I
wanted her to hear it. I think that you all are not cutting, you all are only spraying.”
Parish President Jessie Bellard stated, “No, we cutting. The spraying is catching up to
us thank God but we are cutting, we are cutting grass.”
Public Works Chairwoman Nancy Carriere stated, “I had some people off of Ovey
Benoit Road that were concerned about the spraying because of the animals.”

Parish President Jessie Bellard stated, “It should be okay with the animals.”
Public Works Chairwoman Nancy Carriere stated, “Most animals don’t eat grass unless
they are out in the pasture anyway but that is my concerns if you all can take care of
those two things.”
Parish President Jessie Bellard stated, “Yes we will take care of that.”
Councilwoman Vivian Olivier questioned, “I want to know about Cankton Road.
Remember I asked you about Menard Road?”
Parish President Jessie Bellard stated, “I will have to talk to Barry about that. Barry and
I talked about that. I am not sure what he came up with.”
Councilwoman Vivian Olivier stated, “We had not figured out whether it was for the
state or not.”
Parish President Jessie Bellard stated, “Barry was going to get with Brandon the state
guy and they were going to work something out. He did not tell me one way or the other.
He is on vacation this week but I will get with Precious to make sure that we follow up
on that.”
Public Works Chairwoman Nancy Carriere stated, “One last thing, I also saw
Carrington Place on TV. Is that a private road?”
Parish President Jessie Bellard stated, “That is correct. I am glad that you asked that
question to make sure that we made that announcement. Carrington Place is a private
road and we can’t do anything on private roads. Trust me, we have been trying to work
with certain people but Carrington Place is a private road and we really can’t do nothing
about it. I am glad you brought that up because I wanted to say that but I forgot.”
Public Works Chairwoman Nancy Carriere stated, “It is so unfortunate and I hope
everyone is listening on Facebook. I have gotten many calls about private roads and it is
not a choice decision it is a law so I hope that the people can understand that.”

  1. Discuss the upkeep around the Solar Farms. (Councilwoman Mildred Thierry).
    Councilwoman Mildred Thierry stated, “Mr. Bellard on behalf of the residents in the
    area of the Solar Panels in the parish I would like to make a suggestion that we designate
    a Parish Government Employee to do a monthly drive through around those Solar Panels
    to make certain that they are in compliance. Even before the rain started they were
    slacking with the grass cutting. That is unfair to the people living near those panels. So
    could we put something in place whereas on a monthly basis we have a designated person
    do a drive through? If they see that they need to be reminded give them a call?”
    Parish President Jessie Bellard stated, “Yes, you are looking at her.”
    Councilwoman Mildred Thierry stated, “Okay, thank you. I will check and see to make
    sure that you remembered.”
    Public Works Chairwoman Nancy Carriere stated, “Since she mentioned that I am
    thinking about what Mr. Jolivette said. I know that he said that they violated everything
    with the apartments but with the trash could that fall under littering or can we do
    something about it?”
    Parish President Jessie Bellard stated, “Oh no, I think there is a way to handle it. If it is
    coming from their dumpsters and to prove a criminal charge would be kind of hard but it
    is going to be in violation of our code but we can do a civil part of it.”
    Public works Chairwoman Nancy Carriere stated, “I was asking because a lot of
    dumpsters are locked. After hours the store should be responsible to lock their dumpsters
    and they won’t be able to worry about people going to dump. If she if driving around and

she see that it is overflowing and there are flies can we go and talk to the manager or talk
to someone?”
Parish President Jessie Bellard stated, “I just don’t know. Mr. Duplechain when it
comes to the actual statue I see that it is a problem and I don’t know if they are actually
breaking the law that is the problem.”
Legal Counsel Garett Duplechain stated, “On the criminal side as far as Criminal
Citation for littering we had 4 guilty pleas today for littering. On the civil side we have a
Junk Ordinance that can be enforced if there is junk in someone’s front yard. Of course
going back to the overgrown weeds and grass once the work is done and the invoice is
sent the owner probably does not pay it and you put liens on those properties and those
liens have been paid off recently because we have cancelled some of them in regards to
Junk Ordinance, overgrown grass, littering and things like that as far as the criminal side
and the civil side.”
Public Works Chairwoman Nancy Carriere stated, “I don’t know if you answered the
question as far as the dumpsters.”
Parish President Jessie Bellard stated, “I don’t know if we can enforce it. I don’t know
if we have statue that dictates what we do with dumpsters.”
Legal Counsel Garett Duplechain stated, “If there is a dumpster in someone’s front yard
then our Code Enforcement would take a look at our Junk Ordinance and see if it applies
and inspect it and examine it and see if the Junk Ordinance would be applied to someone
who has junk in their front yard, so it could fit under that ordinance.”
Public Works Chairwoman Nancy Carriere stated, “If you remember and recall Mr.
Ardoin had a concern about an apartment building where cars were staying parked and
broken. I was wondering what could be done to help the neighbors of a business who
should be responsible to keep their business properly safe for everyone.”
Parish President Jessie Bellard stated, “We are going to look at it tomorrow morning
and see what we can do with it.”

  1. Discuss an update on the dredging of Bayou Carron. (Councilwoman Mildred
    Thierry).
    Councilwoman Mildred Thierry stated, “I think Mr. Bellard already dealt with that
    earlier. Maybe he has something to add.”
    Parish President Jessie Bellard stated, “I want to make sure that we are clear on
    something, it is not dredging. I know that is what is worded here because God help us if
    the Core of Engineers even sees that word dredging. We are just cleaning the actual
    bayous by taking the debris out. We are not touching the bottom and digging anything
    because they don’t want to let us dig anything. We are at the point where we are at the
    ending of it and they want to go more with the money. We are waiting for them to get
    reclassified for that $107,000.00 to go a little bit further.”
  2. Discuss any other business properly brought before this committee.
    Councilman Alvin Stelly questioned, “Mr. Bellard did you hear anything about the
    Bayou Portage Bridge? Barry told me something about it costing about $140,000.00 for
    repairs.”
    Parish President Jessie Bellard stated, “Yes Sir. We did get the Engineers Report right
    after the TV station report.”
    Councilman Alvin Stelly stated, “Something is wrong with this.”
    Parish President Jessie Bellard stated, “It is the pilings that are bad underneath there.”

Councilman Alvin Stelly stated, “Well the pilings must have been bad.”
Parish President Jessie Bellard stated, “That is what I said. In less than a year it got that
bad.”
Councilman Alvin Stelly stated, “Yes, there is something wrong.”
Parish President Jessie Bellard stated, “I am with you on that. I was shocked as well
but that is the report that they gave us.”
Councilman Alvin Stelly stated, “I don’t know if you all went to the bridge lately but
somebody went on this side of the Portage Bridge and they open up those barricades but
they could not open those on the other side by the levy but on this side they opened them
up and I don’t know how they opened them up.”
Parish President Jessie Bellard stated, “I will ask someone to go tomorrow and look at it
and see.”
Councilman Alvin Stelly stated, “Somebody could get hurt. I was suppose to call you
yesterday and I forgot about it.”
Parish President Jessie Bellard stated, “That is not a problem, we will go tomorrow.”
Councilman Alvin Stelly stated, “I don’t know how did they move those big cement
barricades?”
Parish President Jessie Bellard stated, “That is where we placed those heavy ones so
they can’t move them. I guess they went with a tractor or something.”
Councilman Alvin Stelly stated, “They moved one side for sure. What is going to
happen with that bridge?”
Parish President Jessie Bellard stated, “They got the P.O. so they are going to do their
work. That company that we gave the P.O. too, we are waiting on them at this point.”
Councilman Alvin Stelly stated, “The same people.”
Parish President Jessie Bellard stated, “I want to say the same people who fixed the top
of the bridge the last time.”
Councilman Alvin Stelly questioned, “Who is going to be liable to pay that again?”
Parish President Jessie Bellard stated, “That is all on us. That is our bridge. I would
like to give it away if we could.”
Councilman Alvin Stelly stated, “That is going to cost like a new bridge.”
Parish President Jessie Bellard stated, “That bridge is so big that is why it is costing so
much.”
Councilman Alvin Stelly stated, “Something is wrong. In less than a year that bridge
went bad. They checked and said they checked it when a new deck was put.”
Parish President Jessie Bellard stated, “Trust me I don’t know anything about bridges
but I am kind of Leary about that one.”
Public Works Chairwoman Nancy Carriere questioned, “Is that the same bridge that
was on TV?”
Parish President Jessie Bellard stated, “Yes Ma’am.”

Public Works Chairwoman Nancy Carriere stated, “Did he give notice that that bridge
was going to be closed? He said it as if he rode up there then all of a sudden the bridge
was closed.”
Parish President Jessie Bellard stated, “Whenever the State does their inspections they
will call us and tell us what they recommend. Their recommendation was to shut it down
immediately so we did that. Again it is up to us to decide whether or not we are going to
close it. On the Off System Bridge Replacement Program part of the deal is that we
listen to what State Engineers say. When they put it in writing and if someone gets hurt
or killed it will be on me so I take their word for it. It happened at that very time and no
notice was given.”
Councilman Wayne Ardoin stated, “I want to advise the council and let the news media
know what DOTD gave us on June 11th, 2025. It was lead out for bid that HWY 178
from HWY 182 at HWY 178 and it goes on the back side through Sunset and comes up at
HWY 182 at the red light by the old Domengeaux Lumber Company. It was lead out for
bid and Elliott Construction Company is the low bidder on it. It was lead out on May
14th, 2025 and according to the engineer that sent Sherell the letter they should be starting
in late August or early September, 2025. At least we will have one road that will be in
decent shape. I have a copy of the letter here if anybody wants a copy.”

I. This meeting was called to order by Vice-Chairwoman Vivian Olivier.
II. The Pledge of Allegiance and Invocation was said by Councilman Faltery Jolivette.
III. Roll Call: PRESENT: Faltery Jolivette, Mildred Thierry, Wayne Ardoin, Timmy Lejeune,
Jimmie Edwards and Ernest Blanchard. ABSENT: Chairman Jody White, Nancy Carriere,
Harold Taylor, Ken Marks, Alvin Stelly and Dexter Brown.

  1. Payment in Lieu of Tax Agreement and Lease Agreement by and between St. Landry
    Parish Energy District (as Lessor) and Opelousas Solar, LLC
    (as Lessee).
    Parish President Jessie Bellard stated, “The first one is with NextEra. We already have one
    working with them now as you all recall, this one mirrors the first one. 65-35 split and the sales
    tax goes straight to the school board and half of the state sales tax will be eliminated and paid to
    the district.”

Councilman Wayne Ardoin questioned, “Mr. Bellard, what is our percentage that we are going
to receive as Parish Government from that tax? The amount that goes to the School Board, will
everyone will get some of that tax? What is Parish Government’s amount?”
Parish President Jessie Bellard stated, “It will be divided up. It goes to the School Board and
they will divide it up like they do any other sales tax that comes in. We get out two cent sales
tax on the Smooth Ride Home and the rest of the agencies in the parish will get their taxes.”
Councilman Wayne Ardoin questioned, “Are there some provisions in there to where as if it
does go de-flunked their property is turned back over to what it was originally?”
Parish President Jessie Bellard stated, “That is correct. That will be underneath our ordinance
under the Decommissioning Plan.”
Councilman Wayne Ardoin stated, “Okay, thank you Madam Chair.”
Councilwoman Mildred Thierry questioned, “I know one of the companies when we found out
about it they had already gone and hand selected some land owners to lease them some property
and have them paying them rent for maybe like a couple of years. When other homeowners
found out about this they were upset and so was I because they were not given a fair chance
because there were others in the area who have 40 or 50 acers of land that they would have been
happy to lease but they did not know anything about it. I would hope if we would go forward
with this we would have them go to the Clerk of Courts Office and get a list of every land owner
in the area that they are referring to and make sure that these people have the opportunity to be
invited to a Public Meeting where they can discuss what is going to happen and they can have
the opportunity if they want to have their land looked at to possibly rent it and not just put
something there. They had been having meeting and we did not know anything about it and
some of it was in my district but no-one had said anything until I started questioning around and
found out what was going on. I would hope that it would be more open to the public, especially
those in that area and everyone given the same opportunity if they are land owners and they want
to lease some of their land to do so and not just a few selected people.”
Parish President Jessie Bellard stated, “So when it comes to that part of it that is a business
decision that these companies have to do. They have land people that go out and pick the land
that is needed. Not everybody gets picked and there is no requirements saying that they have to
go and ask everybody. We do have a Public Hearing and everybody is invited to the Public
Hearing whenever everything comes out. There is nothing that we can do, we don’t have any
zoning in our parish so we can’t make people do something that is not in our ordinance or
anything. I can ask them but again like you just finished saying they are here a long time before
they come and see us and that is because it is done to benefit the company. That is just how it is.
There is nothing that we can do about it. To answer other people’s questions you do what you
can and we do what we can but we don’t have the zoning. I promise you the people that are
affected by this now would want zoning, prior to this they do not want zoning. If it affects them
now they want zoning, so they can’t have both. I can ask them and hopefully they would do it
but we can’t require them too.”
Councilwoman Mildred Thierry stated, “Another thing, with the upkeep, I remember they
promised us that they would have all of these fabulous trees where you would not be able to see
the paneling and they would keep the grass cut. Several times I have passed out there and the
grass is horrible and it needs to be cut. Somebody needs to put some pressure on them.”
Parish President Jessie Bellard stated, “They have that in the agreement, the trees are planted
over there in Plaisance and they will have to grow into it. The grass part of it like everybody else
with all of this rain they cannot cut. I am on them over there. Whenever somebody calls me
about it I call the people and they take care of it. I don’t go and ride but whenever somebody
calls I calls them to make sure that they go and take care of it.”
Councilman Timmy Lejeune stated, “Their leasing process is like Mineral Rights or Oil Leases
where they may lease your piece of property and never do anything and the term runs out. Is that
the same operation?”
Parish President Jessie Bellard stated, “The exact same thing. They don’t activate their leases
until they need them or whenever they are sure they are going to do the project. They pay a

small stipend to hold it but it is not activated until they are ready to pull the trigger which could
be 3 or 4 years down the line.”
Councilman Timmy Lejeune stated, “No further questions, thank you.”
Parish President Jessie Bellard stated, “So we need a motion to accept this.”

Lejeune to authorize the Parish President to sign the Payment in Lieu of Tax Agreement and

    (as Lessee).
    Parish President Jessie Bellard stated, “The next item is the private agreement with Cordelio
    Energy which is the Windfarm okay. This is the first of its kind for us and our parish. We did
    pass an ordinance and everything is in compliance. It mirrors the Solar Ordinance and it mirrors
    the Solar Agreements. We did the same thing 65-35, the same percentages of everything. During
    this conversation they were talking about the noise and the foot print. We went to Mississippi
    and looked at one of the farms, one of the newest farms that they had, not Cordelios’ but I think
    another company. The noise is to a minimum, there is hardly anything. If you hear it you will
    have to be close to it. The foot print is like 1⁄2 acre or 3⁄4 of an acre. They can utilize their farm
    land at the same time. I talked to the farmers in Mississippi and they had more farm land and
    they would lease out more land because it is a win, win for them. I think it is something like 1
    for every 250 or 275 acres. You will not see a whole bunch of them but the surprise for me is we
    have wind in our parish that they want so I say we let them have it.”
    Councilman Timmy Lejeune questioned, “In this agreement if something happens and it goes
    sour do they go and take it out?”
    Parish President Jessie Bellard stated, “The same thing happens with the Decommissioning
    Plan in our ordinance, yes.”
    Councilman Wayne Ardoin questioned, “How many acres are we talking about Mr. Bellard?”

Parish President Jessie Bellard stated, “This goes into our parish and Evangeline Parish. I
forgot the amount of acreage. We have Brian Fontenot with Cordelio here and he is hopping
along.”
Mr. Brian Fontenot of Cordelio addressed the council. He stated, “The bulk of our project is in
Evangeline Parish near Chataignier, the farming community of Chataignier. We have had a lot
of success with speaking with landowners, those farmers really like the idea that it is not going to
take their land out of its primary use of agriculture. As to date the project has a footprint of
about 18,000 acres, a large footprint that will likely get reduced once we get further along into
environmental studies setbacks. We have airport Buffer Zones so things kind of get tightened up
and cleaned up. In St. Landry Parish we currently have about 1,200 acres right there at the
border of Evangeline and St. Landry, sort of on the western side of the parish.”
Councilman Wayne Ardoin questioned, “Will everything be on the north of HWY 190?”
Mr. Brian Fontenot of Cordelio stated, “Yes sir that is correct.”
Mr. Bobby Ardoin, Editor questioned, “Is it along LA 29 between Ville Platte?”
Mr. Brian Fontenot of Cordelio stated, “Yes Sir. It would be kind of deep in the fields there but
that is part of the project, yes sir. We are a little ways away from any kind of construction. We
are looking likely at 2030 to get through all of the permitting and studies ahead. We are
relatively early but the land work is kind of coming towards an end.”
Councilwoman Mildred Thierry questioned, “Excuse me did you say the land work is coming to
an end? What do you mean?”
Mr. Brian Fontenot of Cordelio stated, “Well the land footprint has been well established.”
Parish President Jessie Bellard stated, “The leases.”
Mr. Brian Fontenot of Cordelio stated, “The leases, yes ma’am.”
Councilwoman Mildred Thierry questioned, “So you pretty much already selected those who
will be leasing property.”
Mr. Brian Fontenot of Cordelio stated, “Not entirely accurate. The overall boundary of the
project have been established. We have done a number of studies before we even go into an area
to figure out and make sure that we stay out of these Airport Buffer Zones or any kind of wetland
areas. We have established a boundary and we have partnered with the majority of the major
farm landowners. There are a lot of remaining landowners in that boundary that we are going to
continue to reach out to over the next several years most of which would be 100 acre owners or
less, there a quite a few that we will be speaking with over the next several years.”
Councilwoman Mildred Thierry stated, “Thank you.”
Councilman Faltery Jolivette questioned, “Mr. Fontenot, the analysis as far as safety and all of
that goes in the years what is the projected run time on the windmills?”
Mr. Brian Fontenot of Cordelio stated, “Yes Sir, some modern day turbines have an average life
span of right about 25 years. Every wind lease that we have signed have a 30 year minimum, it
is a long term energy production project so a 30 year minimum on the lease with 2 additional 10
year options for up to 50 years maximum. Modern Day Turbines usually about the year 2025 is
when we do what we call a repowering where turbine blades or components will then be changed
out to newer more efficient technologies and things like that.”
Councilman Faltery Jolivette questioned, “If things go soft and the project is scrapped what do
you do with the Turbines that are standing there?”
Mr. Brian Fontenot of Cordelio stated, “Yes Sir, we have a Development Agreement, a
Decommissioning Agreement and a Road use Agreement that we also like to propose to the
parishes. We have yet to get to that point with Evangeline and St. Landry but we certainly want
to get those in place to make sure that we are taking care of and none of these assets will be left

on sight at the end of life of the project or in the rare event of a bankruptcy of our company.
Also to mention at a certain point and time a lot of the blades and components ended up in the
landfill, thankfully today over 95% of all of the components are recycled.”
Councilman Faltery Jolivette questioned, “Okay cool so they can be put in a municipal
landfill?”
Mr. Brian Fontenot of Cordelio stated, “Yes, when we decommissioned the majority will be
taken off sight for recycling, a small percentage.”
Councilman Faltery Jolivette stated, “I will have more detailed question to come later. I
appreciate it.”
Councilman Wayne Ardoin questioned, “Ms. Vivian was talking about the grass cutting and
keeping the property up with the Turbines we are not going to worry about that because the
landowner is going to take care of the property, am I correct, if he is going to be still farming it?”
Mr. Brian Fontenot of Cordelio stated, “That is correct. Farming operations comes really right
up to the base of the turbine. We have what is called a beauty ring at the base of each turbine,
usually about a 40 foot diameter buildup of Aggregate and stone, keeping that base clean for
those crops and plants.”
Councilman Wayne Ardoin stated, “We won’t have that problem like they have with the Solar
Panel?”
Mr. Brian Fontenot of Cordelio stated, “No sir.”
Councilman Wayne Ardoin stated, “Are you still involved with the Solar Panels on the Ville
Platte Hwy?”
Mr. Brian Fontenot of Cordelio stated, “No, no we don’t do any solar.”
Councilman Wayne Ardoin stated, “You are just involved in locating the properties.”

Parish President Jessie Bellard stated, “Madam Chair, it goes on a long ways but the first
paragraph is what we needed. Basically all we are doing is this: Remember in 2020 we passed
an ordinance dealing with this same act. Since then the law changed on it so we need to revise it.
Instead of revising something we just take one out and put another one back in to replace it to
meet the local standards now. That is the basic just of it. We already have one in place, we
never used it. Since the law changed we need to redo the ordinance. So that is all that we are
doing with this one. This is going on throughout the whole state.”
Councilman Faltery Jolivette questioned, “Is there anyone here that would like to speak?”
Parish President Jessie Bellard stated, “We have some people here from the Eunice Hospital.”
Mr. Sam Colton, Legions Health Management and Mr. David Ingram, CEO, Acadia Medical
Center introduced themselves.
Mr. Sam Colton, Legions Health Management stated, “Just to let you all know we passed it in
Webster and Lincoln Parish. Are there any questions that we can answer for you all?”

Councilman Faltery Jolivette stated, “I was not here when our first ordinance was put together.
I would like to know exactly what this ordinance says in a few words.”
Mr. Sam Colton, Legions Health Management stated, “Basically what the hospital will do is
write a check to the Police Jury. That money will go to the State of Louisiana to help do a

Provider Tax. We are calling it a Provider Tax for right now but it is not really a tax it is a self-
imposed tax, not to the general public but to the hospital. They are doing it in Texas now, they

will take that money and they will send it to the Fed’s and for every dollar that the state have put
up through the different hospitals in the state they will bring down, lets say from 1-3 dollars or
from 1-2 dollars, let’s say, they will bring down more money to go back to the hospitals based on
what they paid on the Provider Tax. We as a provider will pay a tax to the Police Jury, the
Police Jury will send the money up to the state of Louisiana and the State of Louisiana will send
that money up to the Fed’s and come back down and the State of Louisiana will disburse that
money back to each hospital based on what they paid. It is a formula that they have. It is a very
huge long formula and it will help rural hospitals. You all have no idea how big this is to rural
hospitals. There is an article today where I saw there were 700 hospitals across the state that are
looking at closing. People cannot afford to drive 50 miles to another hospital. Most of our
Hospitals in Rural Louisiana are on Medicaid, not Medicare but Medicaid. Let’s say they do an
Orthopedic Surgery it may cost us $4,000.00 but we end up getting reimburse $3,000.00, I am
using this as an example, so it is very difficult and the margin there is very small to make a profit
to keep the doors open. David, you just brought a new CT scan and that cost is $1,000,000.00.
That is a lot of money to put back and re-invest into the community and that is what we will be
able to do. This will help us re-invest back all of its money back into the community and back
into the hospital and update everything that we need to update in the hospitals across the whole
state of Louisiana.
Councilman Faltery Jolivette questioned, “So the Original Ordinance that was adopted in 2020
and with these 5 years, how affective has that been? Has it been working?”
Mr. Sam Colton, Legions Health Management stated, “Yes. What we use now is what we call
a Little Hospital Coalition. This will be additional money to help us make a little more money to
go back into the hospital to hire more employees, hire more nurses and get kids in school and get
them to come back to our local communities. It will not affect people coming to the hospital. In
other words if you come to the hospital, I am not going to charge them this Provider Tax, we
can’t do that and that is not the way it works by the state. We have to do it out of our own
money to pay you all. The insurance company won’t be paying the Provider Tax. We will get
paid by the C P T Codes and that is all that we can charge to the C P T Codes. We will have to
put money aside which is a smart thing to do, if we put up $100.00 to get back $300.00, they
have a big formula, I don’t know the exact amount but that is how it basically works and it will
come back to the state and the state will reimburse each hospital. We have one hospital that will
be in trouble because they may not be able to do this program because of the way this system is
built so we are trying to work where you can do what they call am multi district. We can’t do
anything until after the big bills pass in congress but we are hoping that we can get passes and
we can help another rural hospital because you have to have 2 hospitals in the area for this to
work and at least 2 hospitals to work with this. It is very complicated but it is a great thing for
your community. It is not just for 1 hospital but for all of your hospitals in Rural Louisiana.”
Mr. David Ingram, CEO, Acadia Medical Center stated, “Like I said it is a tax but it is a tax
that the tax payers to do not pay, just the hospitals.”
Mr. Sam Colton, Legions Health Management stated, “They have been doing this in Texas for
years. We are behind that 8 ball a little bit. We are trying to catch up and get this going.”
Mr. Bobby Ardoin, Editor questioned, “Is this kind of like a Medicaid Reimbursement in a
way?”
Mr. Sam Colton, Legions Health Management stated, “It is, I would say. You have to
understand, it is not a Medicaid Reimbursement it is cost reimbursement based on what you pay
on the tax. Whatever the provider tax is that each hospital pay. We may pay, let’s say
$100,000.00 and our hospital in Ruston may pay $300,000.00. So they are going to get back
more money it just depend on what the taxes allocate. We don’t know that because the State of
Louisiana and Department of Health and Hospitals will tell us what we need to pay because there

is some kind of formula that they are using.”
Mr. Bobby Ardoin, Editor stated, “But this will help get you all over.”
Mr. Sam Colton, Legions Health Management stated, “Oh absolutely. Not just us but Rural
Hospital across Louisiana. This is huge.”
Councilman Faltery Jolivette stated, “So it won’t hurt the Patients in any way.”
Mr. David Ingram, CEO, Acadia Medical Center stated, “No Sir.”
Mr. Sam Colton, Legions Health Management stated, “No sir this will help the patients. We
won’t have to send you away. We will have more staff hopefully to hire, we can buy equipment,
we can go and fix the air conditioners and we can pay the electric bills. It will go back to a
General Fund that we can reinvest.” I can promise you that Mr. Bordelon that owns the
company is very consistent that all this money gets reinvested back in each hospital.”
Mr. Harlan Kirgan, Editor questioned, “How will the cost of Medicaid affect this?”
Mr. Sam Colton, Legions Health Management stated, “That is a separate. It is kind of separate
but it is not to the cuts of Medicaid. They are still working on it and I can tell you that I feel that
it is not going to affect us at the present time but we don’t know until Congress pass and we
never know what they are going to do, but hopefully it will work for us. Mr. Bordelon and group
of people from Louisiana have been in Mike Johnson’s office to work out the issues because
Louisiana have one of the highest Medicaid Populations in the country, I think the highest. It
will really affect Louisiana. I say let us not give it to Texas or Tennessee or any of the other
states, let us get our fair share. That is my personal opinion. Are there any more question?

is to the entire state for you all passing this.”

RELATIVE TO THE LOCAL HEALTHCARE PROVIDER PARTICIPATION
PROGRAM IN ST LANDRY PARISH IN ACCORDANCE WITH LA. R. S.
40:1248.1 ET. SEQ.
WHEREAS, the Louisiana Legislature enacted 2020 La. Act 330, which added Subpart
D–1 of Part I of Chapter 5–E of Title 40 of the Louisiana Revised Statutes of 1950, which
was amended by 2024 La. Act 432, comprised of R. S. 40:1248.1 through 1248.10, to
create and provide for a local healthcare provider participation program for the purpose
of financing state and local healthcare expenditures under Medicaid through an
assessment on certain local hospitals within a Parish; and
WHEREAS, the cost of healthcare is increasingly expensive;
WHEREAS, local hospital assessments will result in an increase of the federal matching
funds to be used to pay healthcare costs;

WHEREAS, those local hospitals that will pay the assessments are in support of the local
healthcare provider participation program; and
NOW THEREFORE, BE IT ORDAINED by the St. Landry Parish Council that
Ordinance 2020-024 passed December 16, 2020 and recorded December 17, 2020 is
repealed entirely and replaced with the following ordinance authorizing St. Landry Parish
to participate in a healthcare provider participation program to be codified under Part I,
Chapter 24, Article I, Section 24-34 – Local Healthcare Provider Participation Program,
as follows:
Sec. 24-34.1 Title
This ordinance shall be known and may be cited as the “St. Landry Parish Local
Healthcare Provider Participation Fund Ordinance”.
Sec 24-34.2 Local Healthcare Provider Participation Program Annual Assessment
For the privilege of operating in St. Landry Parish, there is levied upon hospitals, as
identified in La. R. S. 40:1248.1 through 1248.10, a Local Hospital Assessment for each
fiscal year. The rate of the assessment for each fiscal year shall be in accordance with La.
R. S. 40:1248.8 and will be provided annually by resolution of the St. Landry Parish
Council.
Sec. 24-34.3 Adoption of State Law
The Local Hospital Assessment shall be levied, collected and used, or refunded to paying
hospitals, in accordance with the provisions of Louisiana Revised Statutes Title 40,
Subpart D-1 of Part I of Chapter 5-E, as amended, which are adopted and incorporated by
reference.
Sec. 24-34.4 Payments
The Local Hospital Assessment levied herein shall be due annually and may be paid in
quarterly installments. Any payment not paid within thirty days of the due date shall be
deemed delinquent.
Interest at the rate of one-quarter (0.25) percent per month may be added to the amount of
the delinquent payment and such interest shall be computed from the due date of the
payment until it is paid. Such interest may be waived for good cause shown. All penalties
and interest attributable to delinquent Local Hospital Assessment payments will be
deposited and made part of the local provider participation fund.
Sec. 24-34.5 Depository for Local Hospital Assessment Funds
The St. Landry Parish President shall designate one or more banks as a depository for the
Local Hospital Assessment payments received by the parish. A bank designated as a
depository serves until a successor is designated by the St. Landry Parish President.
The Parish may select an appropriate entity to collect the Local Hospital Assessment
payments in accordance with La. R. S. 1248.9. The amount of annual fees for collecting
the Local Hospital Payments that may be paid for each fiscal year shall be in accordance
with La. R. S. 40:1248.8 and 40:1248.9 and will be approved annually by resolution of
the St. Landry Parish Council.
Sec. 24-34.6 Authorized Uses of Local Hospital Assessment Funds
Monies in the local provider participation fund shall not be commingled with other Parish
funds. Excess monies in the local provider participation fund in any given fiscal year may
be carried forward to the following fiscal year.
Monies in the local provider participation fund may be used only as permitted for one or
more of the following purposes or as allowed by La. R. S. 1248.7:

  1. To fund intergovernmental transfers from the St. Landry Parish to the state to provide the
    nonfederal share of a program of Medicaid payments that benefit hospitals in St. Landry
    Parish.
  2. To pay the allowable administrative expenses of St. Landry Parish associated exclusively
    with activities authorized by La. R. S. 40:1248.1 through 1248.10. The amount of
    allowable administrative expenses of St. Landry Parish may not exceed the amount stated
    in La. R. S. 40:1248.8(D).
  3. To refund a portion of a local hospital assessment payment collected in error from a
    paying hospital.
  4. To refund to paying hospitals the proportionate share of money received by St. Landry
    Parish from the Louisiana Department of Health that is not used to fund the nonfederal
    share of Medicaid payment program payments.
    Sec. 24-34.7 Other Necessary Actions
    The St. Landry Parish Council or its representatives as appointed are authorized to take
    all other actions necessary to implement the requirements of Subpart D–1 of Part I of
    Chapter 5–E of Title 40 of the Louisiana Revised Statutes of 1950, as amended by 2024
    La. Act 432, comprised of R. S. 40:1248.1 through 1248.10. To the extent any section of
    the St. Landry Parish Local Healthcare Provider Participation Fund Ordinance is
    inconsistent with or conflicts with the Louisiana Revised Statutes, the Louisiana Revised
    Statutes will control.
    REPEAL: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
    SEVERABILITY: If any provision of this Ordinance shall be held to be invalid, such
    invalidity shall not affect other provisions herein which can be given effect without the
    invalid provision and to this end the provisions of this Ordinance are hereby declared to
    be severable.
    EFFECTIVE DATE: This Ordinance shall become effective fifteen (15) days after
    adoption.
    XII. ADJOURN:
